Nanny Confidentiality Agreement

If you are hiring a nanny to watch your children during the day or a live in nanny that will care for the children full-time, you should consider creating a nanny confidentiality agreement. These agreements are between you and your nanny and are basically used to protect your privacy and to outline living arrangements if needed. These agreements can be used in court in case they are needed and protect the rights of both you and your new nanny.


Finding the right nanny to care for your children can be very stressful. Even though most nannies are trained through nanny services, there are still risks to bringing in a stranger into your home, especially if their job is to care for and protect your children when you are not present. Over the years, there have been many tragic stories of nannies who failed to protect the children they were hired to care for. While these cases are not overly common, they still occur.

When interviewing nannies, you should ask for their credentials, years of experience, references, and other important information you may need. If you have a special needs child, then you may want to hire a nanny that is also a professional nurse. After interviewing the nanny, inform them that if they are hired, they will have to sign a confidentiality agreement. Most nannies are happy to do so, but if some refuse, then you should not hire them.

The nanny confidentiality agreement should include the following:

- Space for both parties to sign

Within this agreement you can specify which rooms of the home the nanny is allowed to be in, protection of the nanny's right to privacy if living on the premises, which information about the household the nanny is allowed to repeat, and what the consequences of breaking the agreement will be. You can choose to let the nanny go if any of the rules stated in the agreement are broken, or you can choose to pursue legal action. The nanny will also have the right to end the relationship if their rights are violated.

Other issues that you could include in the confidentiality agreement include terms of child care, hourly rate, and any other information you would like to include. The agreement can be written by you or by a lawyer. There are also agreements that you can buy online that will allow you to personalize and change whatever you would like so that it will fit your needs.

The agreement should be notarized so that it will hold up in court. After you and your new nanny have signed this agreement and any others, you will hopefully begin to feel better about leaving this new person to care for you children when you are not home. Most people have wonderful relationships with their nannies. The children are well cared for and loved for the time that a nanny is needed.
